ONTARIO ( KTLA) -- Former Westminster police officer Anthony Orban is accused of kidnapping and raping a woman but his defense attorney says he was taking zoloft and neurontin -- anti-depressant medication -- that rendered him incapable of rational thought.

Orban -- an Iraq War vet and former cop -- has been in jail since April of this year. On April 3rd, Orban and a friend -- Jeff Jelinek -- spent the afternoon in Ontario, drinking margaritas and beer.

Orban was on prescription anti-depressants and in an exclusive interview with KTLA, his wife Tracy says, "Something happened to his brain. There's no denying what happened."

According to a complaint filed against him by the San Bernardino County District Attorney, Orban and Jelinek kidnapped a waitress and forced her into her car at gunpoint.

Orban then left Jelinek and prosecutors say that's when Orban forced the victim to drive to Fontana where he brutally raped her in her car, forced her to perform oral sex and shoved his police service revolver in her mouth and texted photos of the attack to Jelinek.

Orban's victim escaped and called 911 and at that point, Orban called his wife, Tracy who told KTLA that, "He didn't have any recollection of calling me. He showed up and he was drugged. He absolutely was drugged. When I was sitting in the car. He was getting ID'd. I knew something happened."

Nevertheless, San Bernardino County Prosecutor Deborah Ploghause says, "We're moving forward and we will litigate in the court of law."

"My biggest thing is, what happened to him I don't want to happen to somebody else," Orban's wife told KTLA.

If convicted, Orban could face 200 years in prison. His family, who stands by him despite the horrific crimes he's accused of committing, are hoping a jury will side in his favor.
