Vacaville teen suspected in rape and stabbing attack will be tried as adult

Sitting quietly in handcuffs in Solano County Superior Court, 14-year-old suspect Alexander Cervantes looked down and shook his head as police officers described a brutal attack and rape of a 13-year-old girl and the attack on her 18-month-old brother late last year.

Following a preliminary hearing Friday, Solano County Superior Court Judge Harry Kinnicutt ordered Cervantes held for trial as an adult on 15 charges with enhancements, including premeditated attempted murder, torture, aggravated mayhem, sodomy on a child under 14, oral copulation on a child under 14, sexual penetration with a foreign object, rape of a child under 14, assault with intent to commit rape, forcing a lewd act upon a child and burglary.

He will be arraigned at 9 a.m. on April 8 in Kinnicutt's courtroom.

Prosecutors say Cervantes broke into the home on Balsam Way in the south side of Vacaville and found the 13-year-old and her 18-month-old brother asleep in the master bedroom, where he then stabbed them multiple times and raped the girl.

Called as a witness by deputy district attorney Mary Nguyen, Vacaville police Detective Dave Marsh testified that, after the attack on Dec. 12, 2010, he interviewed the 13-year-old victim as she was being treated for multiple stab wounds in the Intensive Care Unit at University of California, Davis, Medical Center in Sacramento.

Marsh said he and the doctors counted 42 different stab wounds to the back of her head, neck, upper shoulder and back,

wrists and forearm, with the majority of the stab wounds to her lower back.

According to Marsh, doctors said the victim suffered from a collapsed lung and spleen puncture, caused by a knife.

The teenager was asked by her mother to babysit her younger brother while the mother went out, according to Marsh.

Marsh said the victim woke up to pain in her back.

"She asked the person, 'Why are you doing this?' " Marsh said, adding that Cervantes told her it was revenge for her brother "snitching on someone."

After pleading with Cervantes not to hurt her little brother, the girl told police he turned the knife on the 18-month-old and stabbed him numerous times, according to Marsh, who said there were 13 stab wounds on the baby.

After the attack, Cervantes went to sleep inside the home on the bed in the master bedroom. The girl was able to grab her brother and her cell phone and make her way to the home of a neighbor, where authorities were called.

A SWAT team responded to the scene and after several attempts at contacting the suspect, a battering ram was used to open the front door of the home. Vacaville Sgt. Patrick Williams said he found Cervantes lying on the bed, sleeping naked and covered by a blanket. Williams said the suspect's body was covered in blood.
