[] Family suing hospital over man's death

Relatives of a man who died while being treated for depression at Charter Hospital of Pasco County filed a lawsuit Friday against the facility and his doctor.

Raymond Eliu Pastor Jr. of Spring Hill was admitted to Charter on Sept. 29, 1993, with a primary diagnosis of depression , the family's attorney Charles Sansone said Tuesday. He died Oct. 9, 1993.

The Pastor family contends the hospital and Pastor's doctor, Leo V. Yason, failed to diagnose Pastor's condition properly and were negligent in informing Pastor about the risks associated with medications he was taking to treat his illness, the lawsuit stated.

The complaint filed in circuit court said, Pastor's wife, Michele, and the couple's two children are seeking compensation for medical and funeral expenses, lost income and mental suffering.

Gary Holmes, spokesman for Charter, said Tuesday that neither the hospital nor Yason had been notified of the lawsuit. He had no further comment.

[] Man faces drug charges

A 21-year-old man is charged with conspiring to sell an undercover detective $23,500 worth of cocaine in June.

Jorge Fernando Ortega of 2231 Sand Bay was jailed Wednesday with bail set at $50,000.

The man accused of being Ortega's partner, Libardo Arturo Paz of 4243 Tall Oak Lane in New Port Richey, was arrested in June on the same charge. He has pleaded innocent, according to court records.

Paz told investigators that Ortega was his supplier, a sheriff's report said.

Paz's arrest came less than two months after the 44-year-old pleaded no contest to charges he tried to smother his chronically arthritic wife with a pillow.

A judge sentenced Paz to five years probation in April on aggravated battery and aggravated assault charges stemming from the June 1994 fight with his wife and daughter.

[] Deputies bring builders to Pasco

Deputies brought former builder Myrtle Ann Netherly from Tennessee this week to face charges in Pasco, a sheriff's report said.

Netherly, 41, and husband William "Chet" Netherly, 40, are charged individually with six counts of grand theft, eight counts of misapplication of construction funds and eight counts of misdemeanor perjury.

They owned Premier Homes Corp. until the company unexpectedly closed its doors in 1992 and the couple moved to Tennessee, leaving clients with unfinished homes and subcontractors with unpaid bills.

Myrtle Netherly was arrested on a Pasco warrant Sept. 18 while working at a Nashville department store. Her husband turned himself in at the Land O' Lakes jail on Sept. 29. Each is being held in jail in lieu of $250,000 bail.

[] Man gets 15 years in home robbery

A man accused of invading the home of Port Richey jewelry store owners was sentenced to 15 years in prison after pleading no contest to the charges.

Charles Esco, 31, was declared guilty Monday on two counts of robbery, one count of aggravated assault and two counts of kidnapping, according to court records.

In Esco's trial in July, jurors deliberated about five hours but were unable to reach a verdict. A new trial date hadn't been set.

Circuit Judge William Webb sentenced Esco to 15 years on the aggravated assault charge and and five years on the other charges, court records show. The sentences are to run concurrently, and Webb ordered Esco spend at least three years behind bars before being considered for release.

The victims -- Alfred Elam, 71, and wife Mercedes, 60 -- own a jewelry store in Port Richey. The pistol-carrying intruder who forced his way into their Sea Ranch home in January 1994 demanded the alarm codes to their store and the combination to the vault, the Elams testified.

He also threatened to kill them, they testified.

At one point, Alfred Elam wrestled with the intruder. Mercedes Elam managed to climb out a bathroom window and call deputies from a neighbor's house.

[] Drug charges net man 15 years in prison

A man accused of dealing in large amounts of cocaine and possessing marijuana has been sentenced to 15 years in prison.

Walter Leo Nurnberg, 27, changed his plea from innocent to guilty Monday, court records said. He was charged with trafficking in cocaine and possession of marijuana.

Authorities say they discovered $25,000 in cash and 2.15 pounds, or 976.3 grams, of cocaine in a laundry hamper in a house in Odessa, and Nurnberg told detectives it belonged to him. They also found just more than two ounces of marijuana in the freezer.

[] Man, 36, accused of sexual battery on girl

Deputies arrested a 36-year-old man on allegations he repeatedly had sex with a girl during a four-year period, starting when she was 7 years old.

Edgar Eugene Elswick, of 16514 Platinum Drive, was charged Tuesday with capital sexual battery. He was jailed Wednesday without bail.
