Police cleared in fatal shooting

A Melbourne Coroner has found that police acted in self-defence when they shot a man dead in Shepparton in central Victoria in 2005.
The Coroner said Lee Kennedy took on his wife's surname when they married, and had just learnt she was having an affair when he was shot dead by police at his home in Shepparton in April 2005.
The 40-year-old had called police to have a fictitious person removed from his house. After inviting the officers in, he threatened them with a handgun.
Constable Erin Levay fired the fatal shot.
The Constable burst into tears in court today when the Coroner found she had acted in self-defence.
In her finding, the Coroner Audrey Jamieson said Mr Kennedy had planned his own demise.
The Court heard that Mr Kennedy was also upset about his brother's suicide and had recently been taken off anti-depressants.
The Coroner agreed with a report by the Office of Police Integrity that found Victoria Police had failed to provide ongoing counselling and support to Mr Kennedy's family.
