(FOX 25 / MyFoxBoston.com) - It's a case that has many in the legal community asking a lot of questions.

On Monday morning, 51-year-old Kim Forte, of Wilmington, was out for a walk when she was hit and killed by a driver who was allegedly operating under the influence of drugs.

The driver, Charles McNeil, said that on the day of the crash, he was taking anti-depressants after being released from McLean Hospital, where he was undergoing treatment for depression after the death of his 21-month-old son.

McNeil allegedly took anti-depressants right before the crash. He is being held on $10,000 bail.

David White, an attorney with Breakstone, White & Gluck in Boston, recently joined the FOX 25 Morning News to talk about what McNeil's legal defense may be.
