A man who is in prison for attempted murder of his girlfriend and her aunt more than a decade ago will be re-sentenced within the next few months.

Michael Clements is claiming his sentence was not legal because it involved two weapons enhancements.

He says when he shot the two women, it was one action. The prosecution says two murders, two actions.

The judge decided late last week that the murders were one action, thus he can only be sentenced on one weapons enhancement.

One of two things can happen now: The judge can eliminate five years of Clements’ sentence or Clements can be brought back to Bonneville County for another sentencing.

But this will not change Clements’ original sentence of 15 years to life for the first count of second-degree murder. He is eligible for parole in 2009.
